More new laws, resolutions made public

Hanoi (VNA) – The Presidential Office announced the President’s decision to make public the Civil Code, the Penal Code, the Civil Procedure Code and Criminal Procedure Code during a press conference in Hanoi on December 18.

The Law on Administrative Procedure, Law on Custody and Detention, Law on the Organisation of Criminal Investigative Agencies, and the resolutions on enforcing several laws and codes and the bailiff mechanism were also released.

These laws, codes and resolutions were approved by the 13th National Assembly during the recent 10th session.

Deputy Director of the Supreme People’s Procuracy Nguyen Hai Phong said the Criminal Procedure Code comprises 9 sections, 36 chapters and 510 articles, which has been revised and supplemented to better ensure human rights and citizens’ rights in line with the 2013 Constitution.

Among the new points of the code is the provision that sound or image recording is compulsory during interrogation.

With 42 chapters and 517 articles, the Civil Procedure Code has also been updated to meet requirements of the integration process and realisation of international commitments, including the settlement of cases involving foreigners.

It will take effect on July 1, 2016.

The Civil Code is divided into six sections and 27 chapters. It legalises sex transformation, among many updated stipulations, and will come into force on January 1, 2017.

The Penal Code, valid from July 1, 2016, adds regulations on criminal responsibility of commercial entities found guilty in economic and environmental cases as well as remove death penalty on some crimes.

The Law on Custody and Detention is to take effect on July 1, 2016, and will better ensure the legitimate rights and interest of detainees, according to head of the Ministry of Public Security’s Legal and Administrative Reform Department Nguyen Ngoc Anh.

The resolution on implementing the bailiff mechanism will go into force on January 1, 2016.-VNA
