Legislators debate adjustments, supplements to Law on Intellectual Property

Legislators on May 31 debated the draft Law on amendments and supplements to a number of articles of the Law on Intellectual Property as part of the ongoing third session of the 15th National Assembly.

Hanoi (VNA) – Legislators on May 31 debated the draft Law on amendments and supplementsto a number of articles of the Law on IntellectualProperty as part of the ongoing thirdsession of the 15th National Assembly.

According to member ofthe NA Standing Committee and Chairman of the NA Law Committee Hoang ThanhTung, the Government proposed the adjustments to Clause 2 of Article 7 of the Law on Intellectual Property regarding the implementation ofintellectual property rights on the NationalFlag, National Emblem and National Anthem.

Under the proposal, thedissemination and use of the National Flag, National Emblem and National Anthemmust be in accordance with the law. Organisations and individuals exercisingintellectual property rights related to the National Flag, National Emblem andNational Anthem must not prevent or obstruct the dissemination and use of theNational Flag, National Emblem and National Anthem.

Tung said that the NAStanding Committee found that regulations related to the National Flag, NationalEmblem and National Anthem have been stipulated in Article 13 of the 2013Constitution.

Amid the currentperiod when Vietnam is integrating deeper into the world with more regularexternal affairs and international cooperation activities, the NA StandingCommittee recommended that Clause 2 of Article 7 of the Law on IntellectualProperty should be change as "The exercise of intellectual property rightsmust not infringe upon the interests of the State, the public interests, thelegitimate rights and interests of organisations and individuals as well asother relevant legal regulations. Organisations and individuals exercisingintellectual property rights related to the National Flag, National Emblem andNational Anthem of the Socialist Republic of Vietnam must not prevent orobstruct the dissemination and use of the National Flag, National Emblem,National Anthem,” said Tung.

Meanwhile, regardingthe security control over inventions before filing an application for copyrightregistration abroad, the NA Standing Committee suggested that the bill clarifythe principle and scale of security control over the inventions and assign theGovernment to make details on this issue. The processing of registration applications for confidential inventions should be carried out in accordance with theGovernment's regulations, Tung added.

NA deputies also discusseda number of other contents of the bill, including the restrictions of therights of intellectual protection certificate holders of plant varieties, andlegal responsibility for copyright and related rights for enterprises providingintermediary services./.

Vietnam ready to strengthen BRICS connection with Asia-Pacific

Hang called on countries to act responsibly in accordance with international law and the UN Charter; respect the independence, sovereignty and territorial integrity of states; refrain from using or threatening to use force; and settle disputes peacefully through dialogue. Photo exhibition highlights Vietnam–DPRK relations

Visitors at the exhibition were moved by historical photographs dating back nearly 70 years, including images of the founding leader of the DPRK Kim Il Sung personally welcoming President Ho Chi Minh and a CPV delegation at Pyongyang’s Sunan International Airport during their visit to the DPRK from July 8–12, 1957. In return, the DPRK leader paid an official visit to Vietnam from November 27 to December 3, 1958.
