Hanoi launches pilot mechanism for public interest civil litigation

The coordination framework is designed to ensure that the People’s Procuracy can promptly, fully and accurately access information related to public interest civil cases; facilitate the swift and effective verification and collection of documents and evidence; and strengthen the responsibilities of agencies, organisations and individuals in fulfilling their mandates to protect the civil rights of vulnerable groups and public interests.

Hanoi (VNA) – A signing ceremony of a coordination mechanism between various agencies for piloting public interest civil litigation initiated by the Hanoi People’s Procuracy was held on February 4

Accordingly, the signing involved representatives of multiple agencies, including the People’s Procuracy, Public Security, People’s Court, Civil Judgment Enforcement, Inspectorate, some municipal departments and the Hanoi Tax Department.

The coordination regulation aims to implement the pilot scheme under National Assembly Resolution No. 205/2025/QH15 dated June 24, 2025, which authorises the People’s Procuracy to initiate civil lawsuits to protect the civil rights of vulnerable groups or safeguard public interests.

The coordination framework is designed to ensure that the People’s Procuracy can promptly, fully and accurately access information related to public interest civil cases; facilitate the swift and effective verification and collection of documents and evidence; and strengthen the responsibilities of agencies, organisations and individuals in fulfilling their mandates to protect the civil rights of vulnerable groups and public interests.

Under the regulation, units will proactively coordinate in legal communication and dissemination, receipt and verification of information, collection of documents and evidence, notification and recommendation of lawsuits, litigation support, as well as the initiation, adjudication and enforcement of public interest civil cases.

Speaking at the ceremony, Procurator of the Hanoi People’s Procuracy Dao Thinh Cuong described the signing as a starting milestone for a new operational mechanism, enhancing close information-sharing between the People’s Procuracy and relevant agencies and organisations across the city. He stressed that the coordination regulation not only reflects inter-agency cooperation but also demonstrates a strong political commitment by Hanoi’s authorities to protecting public interests and the legitimate rights and interests of vulnerable groups.

Resolution No. 205/2025/QH15 was adopted in response to the pressing need for more effective legal mechanisms to safeguard the rights and legitimate interests of vulnerable groups and the public interest. In practice, numerous cases involving environmental damage, public assets or civil rights violations have persisted without resolution due to the absence of eligible plaintiffs or the limited capacity of affected individuals to pursue legal action.

The National Assembly’s decision to pilot the People’s Procuracy’s right to initiate such lawsuits marks a new approach, reinforcing the role of the procuracy sector in upholding justice, the rule of law and the common interests of society./.
