Indonesia enforces new Criminal Code after over 60 years of drafting

Indonesian Law Minister Supratman Andi Agtas said the Indonesian Government and the House of Representatives have undergone an extraordinarily long process in drafting the KUHP to replace the Dutch colonial legal legacy. The process began in 1963 and will culminate in the code’s entry into force in January 2026, meaning it took approximately 63 years to complete.

Jakarta (VNA) – The Ministry of Law and Human Rights of Indonesia held a press briefing on January 5 to announce the official effectiveness of the newly enacted Criminal Code (KUHP) from January 1.

Indonesian Law Minister Supratman Andi Agtas was quoted by local media as describing described the move as a major milestone in Indonesia’s efforts to build an independent legal system that reflects the nation’s identity and meets the needs of its modern society.

Agtas said the Indonesian Government and the House of Representatives have undergone an extraordinarily long process in drafting the KUHP to replace the Dutch colonial legal legacy. The process began in 1963 and will culminate in the code’s entry into force in January 2026, meaning it took approximately 63 years to complete.

According to the minister, there has never been public involvement as extensive as this, what he referred to as meaningful participation.

At the event, the official said that in 2025, Indonesia also approved a revised Criminal Procedure Code (KUHAP), further completing the country’s legal reform framework.

Supratman stressed that all provisions in the new KUHP and KUHAP were formulated through extensive and in-depth discussions with the House of Representative, with the involvement of relevant stakeholders across society, and grounded in the principle of protecting human rights.

The official said that both the new Criminal Code and Criminal Procedure Code intend solely to protect human rights while maintaining public order./.
