Supplemental investigation conclusion of case at MoIT and provinces issued

The Ministry of Public Security's Investigation Security Agency has recently issued a supplemental investigation conclusion regarding the case of abusing position and power while performing official duties; lacking responsibility causing serious consequences involving the Ministry of Industry and Trade (MoIT) and some cities and provinces.

Hanoi (VNA) - The Ministry of Public Security's Investigation Security Agency has recently issued a supplemental investigation conclusion regarding the case of abusing position and power while performing official duties; lacking responsibility causing serious consequences involving the Ministry of Industry and Trade (MoIT) and some cities and provinces.

Accordingly, the Investigation Security Agency maintained its stance on the case, proposing the prosecution of 12 defendants on the aforementioned charges.

It recommended to prosecute former Deputy Minister of Industry and Trade Hoang Quoc Vuong for “abusing position and power while performing official duties”. Phuong Hoang Kim, former Director of the MoIT’s Electricity and Renewable Energy Authority, and seven others have also been proposed for prosecution on the same charge.

Additionally, three defendants at the Tax Department of the southern province of Binh Phuoc face prosecution for negligence of responsibility causing serious consequences.”

Investigation results show that Vuong and Kim abused their position and power while performing official duties as the MoIT gave advice to the Prime Minister on implementing regulations regarding the scope of beneficiaries and conditions for preferential electricity pricing policies. Their wrongdoings caused a loss of 937 billion VND (36.76 million USD) to Vietnam Electricity (EVN).

The remainders committed wrongdoings when the Electricity Regulatory Authority issued electricity operation licences, the Electricity Trading Company recognised the commercial operation date, and the Binh Phuoc provincial Tax Department refunded value-added tax to Loc Ninh 3 Energy JSC.

For the three additionally prosecuted, the agency clarified their negligence, which caused serious consequences in the tax refund process for the Loc Ninh 3 Energy JSC.

In addition, in this supplemental investigation conclusion, the Ministry of Public Security has also proposed imposing administrative and Party disciplinary measures against members of the drafting group for Decision No. 13/2020/QD-TTg on mechanisms to encourage the development of solar power projects in Vietnam and individuals involved in the appraisal and verification of the draft; and those connected to the issuance of electricity operation license for the Loc Ninh 3 Energy JSC./.
